It is illegal in the state of Michigan for any one to attempt to commit an offense that is prohibited by law. Attempt of a crime is punishable by the following:
(1) If the crime attempted is one punishable by death, the attempt of the crime is a felony punishable by no more than 10 years imprisonment.
(2) If the crime attempted is one punishable by life imprisonment or for 5 years or more, the attempt of the crime is a felony punishable by no more than 5 years imprisonment in state prison or no more than 1 in the county jail.
(3) If the crime attempted is one punishable by less than 5 years imprisonment or by fine, the attempt of the crime is a misdemeanor punishable by no more than 2 years imprisonment in state prison, or no more than 1 year in the county jail, or by a fine of no more than $1,000.00. MCL 750.92.
