In Michigan there are two punishable degrees of murder. Murder in the first degree is any killing that is willful, deliberate, and premeditated; it is punishable by life imprisonment. MCL 750.316. It is also any murder that is committed during any of the following:

  • Arson,
  • Criminal sexual conduct,
  • Child abuse,
  • A major controlled substance offense,
  • Robbery,
  • Carjacking,
  • Breaking and entering,
  • Home invasion,
  • Larceny,
  • Extortion,
  • Kidnapping,
  • Dueling,
  • Adult abuse,
  • Torture,
  • Killing of a police or corrections officer,
  • Aggravated stalking.


Murder in the second is any other kind of murder and is punishable by life imprisonment, or any terms of years. The sentence is based on the Court’s discretion. MCL 750.317.
