In Michigan it is illegal for anyone to operate a vehicle while intoxicated. Intoxication includes being under the influence of alcohol or a controlled substance. The legal blood alcohol content for anyone over 21 years of age in Michigan is .08. If an individual is found guilty of Operating While Intoxicated and has caused the death or serious injury of another person, they will be guilty of a felony punishable by no more than 15 years imprisonment, a fine of at least $2,500.00 but no more than $10,000.00, or both.

If an individual is simply charged with Operating While Intoxicated (OWI) and there has been no harm to anyone else they face a misdemeanor offense punishable by no more than 1-year imprisonment, a fine of no more than $1,000.00, or no more than 90 days of community service. However, if it is a subsequent OWI charge occurring within 7 years of a prior OWI conviction, then the offense is a felony.
