If an individual is simply charged with Operating While Intoxicated (OWI) and there has been no harm to anyone else they face a misdemeanor offense punishable by no more than 1-year imprisonment, a fine of no more than $1,000.00, or no more than 90 days of community service. However, if it is a subsequent OWI charge occurring within 7 years of a prior OWI conviction, then the offense is a felony.
