It is a misdemeanor in MI, punishable by no more than 1 year in prison, or by a fine of no more than $10,000.00, or both, for any person to sell a tobacco product in MI through the United States mail service unless the product has been previously paid for or a fair market price has previously been agreed upon. MCL 750.42b.

It is also a misdemeanor (punishable by imprisonment of no more than 90 days, a fine of no more than $500.00, community service of no more than 180 days, or a combination) for a person to distribute tobacco products to a person who did not previously pay or agree to pay for the product unless the seller knows that the buyer is at least 18 years of age, is physically present to receive the product, and the distribution is not prohibited by any local ordinance.
